These terms apply to digital products sold by JB Automations, whether bought through this site or through a sales platform (Payhip, Gumroad, Ko-fi, Etsy or others). By buying you accept these terms. The platform’s own terms also apply to the checkout; where a platform acts as merchant of record, it is the seller of record and these terms apply as our product terms and license.
1. Scope
These terms govern the purchase and use of downloadable digital content (templates, spreadsheets, printables, planners and automation files). Nothing in these terms limits or excludes any right you have under mandatory consumer law in the country where you live, to the extent that law does not permit such limitation (see section 10).
2. Seller
Joakim Berg, trading as JB Automations, Norway. Email: joakimberg1990@gmail.com.
3. Products and delivery
All products are digital files; nothing physical is shipped. After payment you receive immediate access to download the files, normally on the confirmation page and by email from the platform. Product descriptions state the file format(s), size and what software is needed (for example Excel, Google Sheets, Canva or a PDF reader). You are responsible for having compatible software. Colours of printed products may vary by printer and paper. If you do not receive your download, email us and we will send it.
4. Prices, taxes and payment
Prices are shown at checkout in the stated currency. Where required (for example EU/UK VAT, Norwegian MVA, Australian GST or US sales tax), taxes are calculated and collected by the platform at checkout. Payment is processed by the platform or by Stripe/PayPal; we never receive your full card details. The contract is concluded when payment is confirmed.
5. Right of withdrawal (EU/EEA, Norway, UK)
Consumers in the EU/EEA, Norway and the UK normally have a 14-day right of withdrawal for distance contracts. For digital content not supplied on a physical medium, the right of withdrawal ends once the download or streaming has begun, provided you (a) gave your express prior consent to immediate delivery and (b) acknowledged that you thereby lose your right of withdrawal (Norwegian Angrerettloven § 22 (n), EU Directive 2011/83/EU Art. 16(m), UK Consumer Contracts Regulations 2013 reg. 37). You give this consent and acknowledgement at checkout, and confirmation is provided on a durable medium (the order confirmation email). If you have not downloaded the product, you may withdraw within 14 days of purchase by emailing us a clear statement (for example: “I withdraw from my purchase of [product], order [number], dated [date]”) and will receive a full refund within 14 days using the original payment method.
6. Refunds
Because digital files cannot be returned, purchases are generally final once downloaded. However, we will always repair, replace or refund (at your choice where the law gives you that choice) if:
- the file is faulty, corrupted or cannot be opened, and we cannot fix it within a reasonable time;
- the product is materially different from its description;
- you were charged twice or bought the same product twice by mistake;
- you did not receive access and we cannot provide it.
Email joakimberg1990@gmail.com with your order number within 30 days of purchase (or within any longer period given by your local law – for example the Norwegian Consumer Purchases Act / EU Digital Content Directive allows complaints about lack of conformity within a reasonable time). Approved refunds are paid to the original payment method, normally within 14 days. Refunds requested through a platform follow that platform’s process as well. Requesting a chargeback without contacting us first does not affect your statutory rights, but please contact us first – we are quick to help.
7. License
When you buy a product you receive a non-exclusive, non-transferable, worldwide, perpetual license to:
- Personal use: download, print, edit and use the files for yourself, your household and as gifts of printed results.
- Commercial use of results: use the files within your own business or for one client/end product at a time (for example running your business with a spreadsheet, printing invitations for an event you organise, or selling printed or finished physical goods made with a template in reasonable quantities).
You may not: resell, share, sublicense, give away or redistribute the original or edited files (digitally or in a template marketplace), include them in another digital product for sale, claim them as your own design, or use them to train AI models. One license covers one person or one business. Product-specific license terms in a listing take precedence over this section. A breach ends the license automatically.
8. Intellectual property
All products, designs, text, images and code are the intellectual property of JB Automations or its licensors and are protected by copyright and other laws worldwide. Some products are created with the help of software and AI tools and are reviewed by us. Third-party fonts, images or trademarks referenced in a product remain the property of their owners. If you believe a product infringes your rights, contact us and we will respond promptly (including to DMCA-style notices).
9. Warranty and limitation of liability
Products are templates and tools for general purposes. They are not financial, tax, legal, medical or professional advice; you are responsible for checking calculations and results and for how you use them. To the fullest extent permitted by applicable law: (a) products are provided “as is” apart from the statutory warranties that cannot be excluded; (b) we are not liable for indirect or consequential loss, loss of profit, data or business; and (c) our total liability for any claim relating to a product is limited to the amount you paid for that product. We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited or excluded by law.
10. Your mandatory consumer rights (savings clause)
If you are a consumer, you keep all rights that the mandatory consumer protection laws of your country of residence give you, and nothing in these terms limits or excludes them. In particular:
- EU/EEA & Norway: statutory conformity rights for digital content (EU Directive 2019/770; Norwegian Consumer Purchases Act / forbrukerkjøpsloven chapter on digital content), plus the withdrawal rules in section 5.
- United Kingdom: rights under the Consumer Rights Act 2015 (digital content must be of satisfactory quality, fit for purpose and as described; repair, replacement or price reduction).
- Australia: our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a refund or replacement, and compensation for other reasonably foreseeable loss.
- New Zealand: the Consumer Guarantees Act 1993 and Fair Trading Act 1986, except where you are buying for business purposes and agree the CGA does not apply.
- United States & Canada: implied warranties and consumer rights under your state or provincial law that cannot be waived. Some jurisdictions do not allow exclusion of implied warranties or limitation of incidental damages, so parts of section 9 may not apply to you. Québec consumers keep all rights under the Consumer Protection Act.
- Brazil: the Consumer Defence Code (CDC) including Art. 49 where applicable; China: the Consumer Rights Protection Law and E-Commerce Law (the seven-day no-reason return does not apply to downloaded digital products, but remedies for defects do); Japan, South Korea, India, Singapore, South Africa (Consumer Protection Act / ECTA) and elsewhere: all non-waivable local consumer rights.
If any provision of these terms is found invalid or unenforceable under your local law, it applies to the maximum extent permitted and the rest of the terms remain in force.
11. Governing law and disputes
These terms are governed by Norwegian law. However, if you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (EU Rome I Regulation Art. 6 and equivalent rules), and you may bring proceedings in the courts of the country where you live. Other disputes are subject to the ordinary courts of Norway. We encourage you to contact us first; most issues are solved within days. Consumers in Norway may also contact the Norwegian Consumer Council (Forbrukerrådet) and the Consumer Complaints Board (Forbrukerklageutvalget); EU consumers may use the European Consumer Centre network (ECC-Net). Nothing in these terms requires arbitration or waives class-action rights where such waiver is not permitted.
12. Other terms
We may update these terms; the version in force at the time of your purchase applies to that purchase. These terms are provided in English; if a translation is made, the English version prevails unless your local law requires otherwise. Personal data is handled under our Privacy Policy.
